Terms of Service

These Terms of Service ("Terms") govern your use of pawnests.com and every purchase you make from it (together, the "Services"). Please read them carefully. By browsing the store or placing an order you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

Your mandatory consumer rights always apply. Nothing in these Terms limits any right you have under the consumer protection laws of the country where you live, including the laws of the European Union, the United Kingdom, Türkiye, Australia, New Zealand, Canada and the United States, which cannot be waived by contract.

1. Who we are

The Services are operated under the trade name Pawnests by Husam Al-Eryani, Omar Bin Alkatab Str Alryan, 1, Madina 52379, Saudi Arabia. Email: Customers-care@pawnests.com. In these Terms "Pawnests", "we", "us" and "our" mean the operator of the Services from time to time (see section 18, Change of operator).

2. Using the store

You may browse the store and see products and prices from anywhere. To place an order you must be at least 18 years old, or have the permission of a parent or guardian, and you must give us correct, current and complete information (name, email, billing and shipping address, payment details). Our store is hosted on Shopify, and Shopify provides the checkout and payment processing.

3. Where we sell and ship

We ship only to the countries listed in our Shipping Policy. If your shipping address is not in one of those countries, checkout will not offer a shipping option and your order cannot be completed. We may limit the quantity of any product per customer, and a product may not be available in every country because of local regulations.

4. Products, prices and descriptions

We try to describe and photograph our products accurately, but colours, sizes and packaging can differ slightly from what you see on screen. Prices are shown in US dollars unless the store shows another currency, and may change at any time; the price that applies is the one shown when you place your order. Prices include or exclude taxes and import charges as shown at checkout (see section 6). If we discover a pricing or description error after you ordered, we will tell you and you may choose to confirm your order at the correct price or cancel it for a full refund.

5. Orders and payment

Your order is an offer to buy. A contract is formed when we send you an order confirmation email and accept your payment. We may decline or cancel an order, for example because of suspected fraud, a stock or pricing error, or an address in a country we do not serve; if we do, we will tell you and refund any amount you have paid. You confirm that the payment method you use is yours or that you are authorised to use it. Payments are processed securely by Shopify and its payment partners; we do not see or store your full card number.

6. Taxes, customs and import duties

Where VAT, sales tax or import charges are collected at checkout, they are shown before you pay. Otherwise, import VAT, customs duties and handling fees charged by your country or the carrier are the responsibility of the recipient. Please see the Shipping Policy for details.

7. Delivery

Estimated delivery times are listed in the Shipping Policy. They are estimates, not guarantees, but they are the delivery period we agree with you when you order. If your order has not arrived by the end of that period, contact us; where the law gives you the right, you may then ask us to deliver within a reasonable additional period or cancel the order for a full refund. Risk of loss or damage passes to you when the goods are delivered to you, except where the law of your country says otherwise.

8. Returns and refunds

Returns, withdrawals and refunds are governed by our Return & Refund Policy, which gives a 14-day right of withdrawal in the European Union, the United Kingdom and Türkiye and a 7-day return period in our other supported countries. That policy forms part of these Terms. Your statutory rights, including the legal guarantee for defective goods, are not affected.

9. Pet products and safety

Pet products must be used responsibly. Please read the product description and any instructions, choose a size and type suitable for your pet, and supervise your pet, especially when first using a toy, harness, collar, bed or feeding accessory. Chew toys and small parts can be a choking or swallowing hazard; remove and replace a product that is damaged or worn. Grooming products, treats and supplements are not a substitute for veterinary advice, diagnosis or treatment. If your pet has a health condition, allergies or special dietary needs, speak to a veterinarian before use. Content on our website is for general information only.

10. Intellectual property

All content on the Services, including the Pawnests name and logo, text, product descriptions, images, graphics, videos and the design and arrangement of the store, belongs to us or our licensors and is protected by copyright, trademark and other laws. You may use it for your own personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, republish or use it commercially without our written permission.

11. Reviews, messages and other content you submit

If you submit a review, photo, comment or other content ("Content"), you confirm that it is truthful, that you have the right to share it and that it does not break the law or anyone's rights. You keep ownership of your Content, and you give us a non-exclusive, royalty-free, worldwide licence to display, reproduce and use it on our website, social media and marketing. We may remove Content that is unlawful, abusive, misleading or otherwise objectionable.

12. Acceptable use

You agree not to use the Services for any unlawful or fraudulent purpose; to attempt to gain unauthorised access to the store or its systems; to introduce viruses or other harmful code; to collect data from the store with automated tools (scraping); to place orders for commercial resale or export without our agreement; or to interfere with other customers' use of the Services.

13. Third-party links and services

The Services may contain links to third-party websites and use third-party tools, such as Shopify, payment providers and carriers. We are not responsible for their content, products or policies, and your use of them is subject to their own terms.

14. Our relationship with Shopify

Pawnests is powered by Shopify, which provides the platform for the Services. Sales and purchases made in the store are made directly with Pawnests, not with Shopify. Shopify is not a party to the contract between you and us and is not responsible for the products you buy, the delivery of your order or any aspect of the sale. Shopify collects and processes personal information about your use of the Services to provide the platform; see our Privacy Policy and Shopify's own privacy policy for details.

15. Disclaimer and limitation of liability

Subject to the paragraph below, the Services are provided "as is" and "as available", and to the fullest extent permitted by law we do not give warranties other than those that the law of your country requires us to give. We are not liable for indirect or consequential losses, such as lost profits, that were not reasonably foreseeable, or for losses caused by events outside our reasonable control (for example carrier delays, customs processing, natural events, strikes or failures of the internet or of third-party platforms).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under product-liability laws, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, you keep all the rights and remedies given to you by the law of your country, such as the legal guarantee of conformity for goods in the European Union, the Consumer Rights Act 2015 in the United Kingdom, the Australian Consumer Law and the Consumer Guarantees Act 1993 in New Zealand.

16. Indemnity (business customers only)

If you buy for business purposes (not as a consumer) you agree to compensate us for losses and reasonable legal costs resulting from your breach of these Terms or your violation of any law or third-party right. This section does not apply to consumers.

17. Termination and severability

We may suspend or end your access to the Services if you seriously or repeatedly breach these Terms or misuse the Services, without affecting orders already accepted and paid for. If any part of these Terms is found to be invalid or unenforceable, the rest remains in effect, and the invalid part is replaced by the valid provision closest to its purpose.

18. Change of operator

We plan to move the Pawnests business into a company. We may transfer the Services, these Terms and the data described in our Privacy Policy to that company or another successor, provided it takes over our obligations to you. We will publish the new operator's name and address on this website and in the Contact information, and where the law requires we will notify you. Your statutory rights and any orders already placed are not affected by a change of operator.

19. Governing law and disputes

These Terms are governed by the laws of the country where the operator of Pawnests is established, which is currently Saudi Arabia, without affecting the mandatory consumer protection laws of the country where you live. If you are a consumer in the European Union, the United Kingdom or another country whose law gives you this right, you may bring a claim in the courts of your country of residence, and you keep the protection of your country's mandatory laws. Before starting a dispute, please contact us at Customers-care@pawnests.com; we will try to resolve it quickly and in good faith.

20. Changes to these Terms

We may update these Terms from time to time by posting the new version on this page with a new effective date. The version in force when you place an order applies to that order. If we make a material change that affects your existing rights, we will notify you as required by law.
